No. You place your trades. FOMI is a rules engine and risk
guard that checks each order against your settings (e.g., max
risk per trade, position size/leverage caps, required SL/TP,
daily loss limits, lockouts, allowed pairs).
FOMI Guardian is a feature that monitors your trading activity
and blocks any trades not aligned with your risk management.
It acts as your personal trading guardian in case you lose

- "Guardian" means our automated risk-controls feature.
4. Eligibility & Account Responsibility
You must be legally able to form a binding contract in your jurisdiction. You are responsible for safeguarding your credentials and all activity under your account.
5. Use of Service
FOMI provides tools to help users enforce self-defined trading rules. All trading decisions and outcomes remain solely your responsibility.
6. No Financial Advice
The Service is for educational and informational purposes only and does not constitute investment, legal, tax, or financial advice.
7. Regulatory Status & Non-Custodial Nature
FOMI is not a broker, dealer, exchange, investment adviser, or fiduciary. We do not custody funds, execute withdrawals, or hold user assets. All trades are executed directly on third-party Exchanges under your control.
8. Subscription & Billing
The Service is subscription-based. Fees, billing cycles, and renewal terms are shown at checkout. Subscriptions renew automatically unless canceled before the next billing date.
Payments are non-refundable except where required by law or expressly stated otherwise.
9. API Key Usage & Exchange Connections
You are solely responsible for configuring API keys. Never enable withdrawal permissions.
10. FOMI Guardian (Automated Risk Controls)
By enabling Guardian, you authorize FOMI to send cancel or close instructions on your behalf. Guardian operates on a best-effort basis only.
11. Platform Availability & Restrictions
Certain Exchanges may restrict access based on location or regulation. You are solely responsible for compliance with applicable laws.
12. Risk Acknowledgment
Trading involves substantial risk, including total loss of capital. FOMI does not guarantee accuracy, performance, or availability.
13. Limitation of Liability
To the fullest extent permitted by law, FOMI shall not be liable for indirect, incidental, consequential, or punitive damages.
Total liability shall not exceed the greater of $100 or the amounts paid by you in the prior three (3) months.
14. Indemnification
You agree to indemnify and hold harmless FOMI from claims arising from your use of the Service or violation of these Terms.
15. Intellectual Property
All content and software are owned by FOMI or its licensors. No rights are granted except as expressly stated.
16. Feedback
Any feedback you provide may be used by FOMI without restriction or compensation.
17. Termination
We may suspend or terminate access if you violate these Terms or create legal or operational risk.
18. Force Majeure
FOMI is not liable for delays or failures caused by events beyond reasonable control, including outages, regulatory actions, or Exchange failures.
19. Governing Law & Venue
These Terms are governed by Florida law. Any disputes shall be brought in courts located in Florida.
20. Entire Agreement & Severability
These Terms constitute the entire agreement. If any provision is held unenforceable, the remainder remains effective.
